GLO Participates in the Hong Kong Arbitration Week 2013 as Sponsor

Hong Kong Arbitration Week 2013 was successfully held on October 21-24, 2013, in Central, Hong Kong. Our firm participated in this event as silver sponsor of the seminar, “Arbitration in Mainland China: Law and Practice”, which was held by China International Economic and Trade Arbitration Commission (CIETAC) Hong Kong Arbitration Center. This event was hosted by several institutions, including Hong Kong International Arbitration Centre (HKIAC), CIETAC Hong Kong Arbitration Center, International Chamber of Commence-Hong Kong China, Inter-Pacific Bar Association (IPBA), Global Arbitration Review (GAR), etc. The guests were government officials, scholars and professionals from law firms.

 

Steve Liyun KOU and May SHEN, our attorneys from the Dispute Resolution Division, participated in the event. During the seminar of “Arbitration in Mainland China: Law and Practice”, which was held by CIETAC ,  Mr. Kou made a speech regarding  the issue of the property preservation and interim measures in arbitration in the unit of "Arbitration and Judicial". He analyzed that the new version of the Mainland China Civil Procedural Law made modifications on civil preservative measures, in which two aspects existed: the parties might apply for preservation measures before initiating an arbitration, and act preservation system had been set up. These modifications provided a statutory legal basis for the parties to apply to the court for granting interim measures, which would order  the opposing party to perform certain actions in arbitration. Based on the above-mentioned rules of new Mainland China Civil Procedural Law, we predict that the courts will recognize and enforce the interim measures made by arbitral tribunal in subsequent judicial practice.
